Socio-legal phenomenon: efficiency as a historically determined balance between public and private interests

Abstract

Using specific examples of judicial practice, the article examines the socio-legal phenomenon of the effectiveness of individual legal regulation, which is presented as a certain historically determined socially acceptable balance between public and private interests, and also identifies the issues under study and out-lines ways to resolve the contradiction between the normative definition of the possibilities of individual behavior of the subject of individual regulation and the limits of these possibilities.
The paper shows the need to develop a set of scientifically based theoretical provisions and scientific and practical recommendations to solve the problems of this socio-legal phenomenon at the conceptual level, objectified in normative le-gal acts, standard-setting and law enforcement activities.
