Sociological specifics of the phenomenon of legal culture
Abstract
In the article author considers the phenomenon of legal culture. It’s shown that the legal culture is studied within the framework of the sociology of law and the sociology of management. The emphasis is placed on the fact that it’s extremely important to distinguish between the legislative, formal consolidation of legal relations and their real embodiment in the life of individuals, social groups, organizations. The author presents a study of legal phenomena at the macrosociological and microsociological levels. At the macrosociological level of legal phenomena the social causes that caused these norms of law and their consequences are investigated. Microsociological directions are quite productive for the study of legal culture. Followers of microsociological approaches developed the idea that the legal system exists not only in the form of an objective structure that is external to individuals. It develops in the course of interaction between individuals who are bound by a certain subjective meaning. The sociological approach to legal culture allows us to interpret it as part of the general culture. Legal culture is embodied in legal knowledge, legal consciousness, legal norms, legal attitudes, and legal behavior. In the article, the author presents the results of an empirical study, which are interpreted using a microsociological approach.
